Uncontested Divorce in Thailand
Divorce Procedure
Divorcing couples must appear in person before the local registration office to conduct the procedure. A family member, attorney, or lawyer cannot represent them. Personal appearance is necessary because the parties must answer questions regarding their decision to end the marriage. The officer must verify that the parties' decision to divorce was made voluntarily and without coercion.
Traditionally, couples were required to divorce in the same Amphur where they registered their marriage. Still, recently couples have been allowed to obtain an uncontested divorce in an Amphur other than where the marriage was registered. Amphur may require more documentation before the divorce is processed.
Documents required for an uncontested divorce in Thailand
If divorcing in the same Amphur where you registered your marriage:
- Thai citizen
- Marriage certificate
- Thai National ID
- Home Registration Certificate (Ta bien ban)
- Foreigner
- Marriage Certificate
- Passport
If Amphur office is different from where your marriage is registered:
- Thai citizen
- Marriage certificate
- Thai National ID
- Home Registration Certificate (Tabien baan)
